Minutes of the Work Session

Denali Borough Assembly

October 8, 2003



CALL TO ORDER            Presiding Officer Jim Caswell called the work session to order at 6:35 pm.


ROLL CALL               Assembly members present were: Jim Caswell, Sid Michaels, Bob Shelton, Neal Laugman, Dave Evans, Gerald  Pollock, and Baxter Mercer.  Assembly members Cynthia Trytko, and Teresa Hall were absent.  Mayor Talerico was also in attendance. 


                                    LAUGMAN stated that he is giving the Assembly notice that he will be turning in a letter of resignation for Assembly, Seat G. He apologized for putting the Assembly in this position but because he has decided to live in the Panguingue Creek area, he must resign from his current seat.


                                    CASWELL stated he is here and is informed and that he should remain on the Assembly.


                                    Mayor Talerico stated that Laugman has changed his residency and the Charter states that he would immediately forfeit his seat. LAUGMAN agreed.


1.)  Mayor’s Annual Work Plan.


Mayor Talerico explained his Annual and Three- year Work Plan. Mayor Talerico explained that this is the first work plan and hoped it would be useful.  He also stated that the Annual Work Plan would need to be adopted by the Assembly however, the Three-year Plan is a working documents.  MICHAELS noted that the City of Anderson has some potential lands available  within the northern area that should be mentioned in the plan.  The Mayor concurred.


MERCER would like to see an aggressive effort toward surveying the Municipal Lands.



2.)  Ordinance 03-03, Version B, an ordinance amending the Denali Borough Code of Ordinances, Chapter 21, pertaining to severance tax.


EVANS  would like to change some language during the Regular meeting as follows:

            Section 2. Definitions

A.)  Delete “and sold”


Section 4. [Permit]

[B.)] Add “and all delinquent severance taxes are paid in full”, the clerk….



Section 5. Exemptions

A.)    All projects for the Denali Borough where the Denali Borough provides the severed resources being used.

B.)    Single extraction events from civil excavations under 1000 cubic yards that are utilized on site.


MICHAELS stated on Page 1, Section 1,  “Classification” is on the page twice. Drop # 1 and renumber, drop # 11 in the body of the Chapter, and delete “Section 1 Classification.  Effective date on page 5 should be number 3.


Because of time constraints, the following items were not discussed.


3.)  Ordinance 03-08, Version C, an ordinance amending the Denali Borough Code of Ordinances, Title IV, Chapter 24, titled Management of Borough Real Property.


                                    4.)  Ordinance 03-12, Version A, an ordinance amending the Code by addition of Title 5, Chapter 36, titled a Code of Ethics for the Denali Borough Mayor, Assembly and Borough employees.




                                    5.)  Ordinance 03-13, Version A, an ordinance amending the Code by the addition of Title 5, Chapter 37, creating an Ethics Commission.


                                    6.)  Ordinance 03-14, Version A, an ordinance amending the Code by the addition of Title 5, Chapter 38, creating the Denali Borough Ethics Commission Policies and Procedures.


                                    7.)  Ordinance 03-15, Version A, an ordinance amending the Code, Appendix of Forms P, Q, R, S, T, U, and V, pertaining the Code of Ethics.


                                    8.)  Ordinance 02-06, Version A, an ordinance providing for an ethics commission and providing for disposal of alleged violations.


                                    9.)  Ordinance 03-17, an ordinance establishing land use regulations to conform to requirements of the National Flood Insurance Program and providing for an effective date.


                                    10.)  Ordinance 03-18, an ordinance amending the Denali Borough budget for fiscal year 2004.




ADJOURNMENT            CASWELL declared the work session adjourned at 6:59 pm.
