DENALI BOROUGH, ALASKA
ORDINANCE NO. 95-07

AN ORDINANCE AMENDING CHAPTER 35 OF
THE DENALI BOROUGH CODE OF ORDINANCES.
BE IT ENACTED by the Assembly of the
Denali Borough, Alaska that:
Section
1. Classification.
This ordinance is of a general and
permanent nature.
Section
2.
The purpose of this ordinance is to amend
Chapter 35. The ordinance is amended as
follows:

Section
1. Duties and Functions.
A.
The Planning Commission shall prepare and recommend to the Borough
Assembly:
1.
a comprehensive plan consisting of maps and related tests for the
systematic development of the Borough;
2.
a zoning ordinance to implement the comprehensive plan;
3.
a subdivision ordinance;
4.
the official map of the Borough.
Said map shall include reference to zoning and other applicable
restrictions prescribed by the
commission;
5.
municipal land entitlement recommendations; and,
6.
modifications to the documents specified in (1) ‑ (5) of this
section.
B.
The Commission shall publish notice of and hold at least one public
hearing before submitting its recommendations under (A) of this section to the
Assembly. Notice shall be published in
the same manner as in the case of ordinances.
C.
The planning commission shall:
1.
act as the platting board;
2.
act upon requests for variances; and,
3.
act upon requests for conditional uses.
D.
Subject to any ordinance adopted pursuant to AS 29.33.245, no platting
request, variance or conditional use may be granted except upon an affirmative
vote of a majority of the voting members of the Commission.
Section
2. Comprehensive Plan.
A.
The comprehensive plan provided for in Section 1 (A)(1) shall be a
compilation of policy statements, goals, standards and maps for guiding the
physical, social and economic development, both private and public, of the
Borough and may include, but is not limited to the following; statements of
policies, goals, standards, a land use plan, a community facilities plan, a
transportation plan, and recommendations for plan implementation.
B.
The Borough Assembly shall adopt a comprehensive plan based upon the
recommendations of the planning commission.
The Borough Assembly may modify the plan, provided that it first obtains
the recommendations of the Planning Commission. The Planning Commission shall undertake an overall review of the
plan at least once every two (2) years and shall present recommendations based
on the review to the Borough Assembly.]
A.
All land control political power is inherent in the people as a Home
Rule Borough Government. All Home Rule
Government originates with the people, is founded upon their will only, and is
instituted solely for the good of the people of the Denali Borough.
B.
The Planning Commission powers shall remain inherent in the elected
officials of the Denali Borough Assembly.
C.
The Denali Borough shall maintain and elect a Land Planning Committee
which shall remain in compliance with Chapter 13 of Denali Borough Home Rule
Charter.
D.
The Denali Borough Land Planning Committee shall prepare and recommend
to the Borough Assembly, at the discretion of the Mayor the following:
1. Maps and related tests for development of
the Borough;
2. Municipal Land Entitlement recommendations;
3. Modifications to documents, as needed;
4. Planning, Platting, and Land Use Regulation,
as needed.
E. The Land Planning Committee shall publish
notices of and hold at least one Public Hearing before submitting it’s
recommendations. Notices shall be
published in the same manner as in the case of Ordinances.
F.
Appeals from Administrative Decisions
A. By ordinance of the Denali Borough
Assembly shall provide for an appeal from
an administrative decision,
application of a Land Use
Regulation adopted under this Section 35.
The assembly may provide for an appeal to a Court, Hearing Officer,
Board of Adjustment, or other body. The
Assembly shall provide for an appeal from a decision on a request for a
variance from the terms of a Land Use regulation when literal enforcement would
deprive a property owner rights commonly enjoyed by other properties in the
area or district.
B. By Ordinance the Assembly may provide for
appointment of a Hearing Officer, or for the composition, appointment, and
terms of office of a Board of Adjustment or other body established to hear
appeals from Administrative Actions.
The Assembly may define proper parties and prescribe evidentiary rules,
standards of review, and remedies available to the Hearing Officer, Board of
Adjustment, or other body.
Section 3.
Municipal land entitlement. The municipal land entitlement shall refer to the land selected
or nominated for selection to satisfy a general grant land entitlement.
Section
4. Effective Date. This ordinance becomes effective upon adoption by the Denali
Borough Assembly and signature of the Mayor.
