AN ORDINANCE AMENDING SECTION 12.02 OF ARTICLE XII (SERVICE AREAS)

OF THE CHARTER OF THE DENALI BOROUGH.

BE IT ENACTED by the Assembly of the Denali Borough, Alaska that:

Section 1. Classification.

This ordinance is of a general and permanent nature.

Section 2. Article XII, Section 12.02 amended.

Section 12.02 of Article XII of the Denali Borough Charter is hereby amended to read as follows:

Section 12.02

Establishment

1.) By ordinance. The Assembly by ordinance may establish, alter, consolidate, or abolish service areas [. The Assembly by ordinance may add or eliminate services to a service area.] provided such an ordinance is approved by a majority vote at an election by the registered voters within the effected area. When more than one area is to be effected, then both areas must approve the ordinance. Service areas may include, by a vote of the area people, but are not limited to, fire protection, garbage disposal, snow removal, and road maintenance. Also, all taxes, fees, and levies for services in a service area must be approved by a majority vote of the voting voters at an election of the voters within the service area. The ordinance shall also contain the following:

A. boundaries and areas to be included;

[B. service to be provided or be eliminated; and]

[C.]B. other provisions the Assembly includes.

2.) By petition. Procedures for the establishment by petition of a service area shall be in accordance with Section 6.01 of this Charter as it would apply to the area in question.

Section 3. Effective Date. This ordinance becomes effective upon adoption by the Denali Borough Assembly, signature of the Mayor and approval by a majority of the voter at the next regular election of the Denali Borough.
