CALL TO ORDER††† Presiding Officer Jerry Mueller called the public hearing to order at 3:00 pm.

 

ROLL CALL†††††††††††††† Assembly members present were: Sid Michaels, Jim Caswell, Jerry Mueller, Teresa Hall, Jim Payne, Gerald Pollock, Carol Shields, Teresa Usibelli, David Talerico and Mayor Gonzales.

 

††††††††††††††††††††††††††††††††††† Mayor Gonzales introduced Borough Attorney Jim Gorski, and Denali Borough School district Superintendent Bob Wicker, and Usibelli Coal Mine representative Charlie Boddy.

 

1.)   Ordinance 01-10, Version B, an ordinance amending the Denali Borough Charter, Article XI, Section 11.01, regarding a sales tax.(Introduced by Assembly member Jerry Mueller)

 

Panguingue Creek resident David Braun said it seems to him there is a rather glaring omission in the sales tax, and that is that there is no tax on restaurants.He said there is a tax on dinner theaters, but not on all restaurants.He said that brings up the possibility of a conflict of interest.Braun said one of the members of the Revenue Development Task Force and the facilitator of the Task force has ties to the Clear Sky Restaurant.He said he feels they should eliminate themselves from the decision making process.

 

2.)   Ordinance 01-13, Version A, an ordinance establishing a 2% general Sales tax within the Denali Borough.(Introduced by Assembly member Teresa Hall)

 

There were no comments.

 

3.) Ordinance 01-12, Version B, an ordinance adding Title III, Chapter 22A, titled Excursion Tax to the Denali Borough Code of Ordinances.(Introduced by Assembly member Scott Stowell)

 

There were no comments.

 

4.) Ordinance 01-07, Version A, an ordinance amending the Denali Borough Code of Ordinances, adding Chapter 22, pertaining to business licenses.

 

There were no comments.

 

5.) Ordinance 02-07, Version A, an ordinance amending the fiscal year 2003 budget.

 

There were no comments.

 

6.) Ordinance 02-08, Version A, an ordinance creating Title IV, Chapter 27 of the Denali Borough Code of Ordinances providing for classification of Borough-owned land.

 

Healy resident and member of the Land Use Planning Committee Charlie Loeb stressed the importance of the fact that this ordinance only applies to land owned by the Borough.He said in the beginning of the ordinance there are five purposes.He said if any member of the Assembly does not agree with any of those purposes, or feels there should be other purposes, they need to voice those purposes.Loeb said there are two very important reasons to classify lands:1.)He thinks itís very important to provide an avenue for members of the public to participate in how and why lands are classified.2.)He said if you just have the land floating out there, there is no guarantee that the decision of the moment is the best decision for that land.He said itís important to do some planning.He said it could be that having an unrestricted category is OK, but the Borough should still go through the process of classifying that land.
