DENALI BOROUGH, ALASKA

ORDINANCE NO.   96-02

AN ORDINANCE AMENDING THE DENALI BOROUGH CODE OF ORDINANCES, BY AMENDING CHAPTER 6 PERTAINING TO THE MAYOR BEING DESIGNATED THE DISASTER EMERGENCY COORDINATOR.

 

BE IT ENACTED by the Assembly of the Denali Borough, Alaska that:

 

 

Section 1.  Classification.  This ordinance is of a general and permanent nature. 

 

Section 2.  Amendments to Chapter 6.  Denali Borough Code of Ordinances is amended as follows:

 

Chapter 6, Section 3B, #14 is renumbered as #15.

 

            Chapter 6, Section 3B, #14 to read:  serve as the Disaster Emergency Coordinator; and,

 

Chapter 6, Section 11 to be added.

 

Section 11.  The Mayor is the Disaster Emergency Coordinator.

 

 

  A.  Responsibility established.  Executive and administrative duties are vested in the office of the Mayor, who may appoint such other personnel as shall be found necessary to properly and safely accomplish the purpose of Disaster Emergency Coordination.

 

  B.  Purpose.  It is the desire of the Borough to protect and preserve the lives, health, safety, and well-being of the people living in or visiting the borough.  To this end, the disaster emergency coordinator shall be responsible for implementing the approved disaster emergency response plan, and shall be the liaison with the Alaska Division of Emergency Services.

 

  C.  Disaster emergency response plan.  The disaster emergency coordinator shall utilize the Denali Borough LEPC All-Hazards Plan.

 

  D.  No governmental or private liability.

 

(1) No disaster emergency coordinator or authorized emergency response personnel while in proper performance of his/her required duties shall be held liable for any damage sustained to persons or property as a result of emergency response activity except and unless gross negligence or willful misconduct is proven.

 

(2) No person owing or controlling real property, who allows the use of that property for disaster response activities shall be held liable for  death or injury resulting from that use, except and unless gross negligence or willful misconduct is proven.

 

 

 

Section 3.  Effective Date.  This ordinance becomes effective upon adoption by Denali Borough Assembly and signature of Mayor.
