AN ORDINANCE ESTABLISHING A
COMMERCIAL / INDUSTRIAL ZONE SURROUNDING THE DENALI BOROUGH LANDFILL
BE IT
ENACTED by the Assembly of the Denali Borough, Alaska that:
Section
1. Classification.
This
ordinance is of a general and permanent nature.
Section
2. Purpose.
The purpose
of this ordinance is to exclude the land area surrounding the Denali Borough
landfill from residential development and other uses not compatible with a
landfill, thereby avoiding future conflicts.
Section
3. Authority.
Alaska
State Statues: 29.35.180 Land Use Regulation (b) A home rule borough shall
provide for planning, platting, and land use regulation.
Section
4. Geographical Location.
The
Industrial / Commercial Zone is designated as all the land located in sections
26, 34, and 35 of Township 7 South, Range 8 West, Fairbanks Meridian that does
not lie within the boundaries of the City of Anderson. (Anderson Municipal Code 1.04.060)
Section
5. Definitions.
For the
purpose of this ordinance, the following words shall have the meanings set
forth below.
A. “Industrial”
means manufacturing; fabricating; assembly; disassembly; processing; treatment facilities; mineral exploration, extraction, and
processing; and refineries. Uses NOT
permitted include, but are not limited to, residential dwelling units, bed and
breakfast establishments, schools, campgrounds, and cottage businesses.
B. “Commercial”
means retail, office, wholesale, personal services, agricultural, and other
general service uses for the consumer population. Uses NOT permitted include,
but are not limited to, residential dwelling units, bed and breakfast
establishments, schools, campgrounds, and cottage businesses.
Section
6. Variances.
Request for
variances to the above zoning must be made to the Denali Borough Planning
Commission. The City of Anderson will
be notified of any request for variances.
Section
7. Appeals.
Decisions
of the Planning Commission can be appealed to the Denali Borough Assembly.
Section
8. Effective Date.
This
ordinance becomes effective upon its adoption by the Denali Borough Assembly.
