AN ORDINANCE REPEALING AND REENACTING ARTICLE VII OF

THE DENALI BOROUGH CHARTER CONCERNING BOROUGH

PLANNING, PLATTING AND LAND USE REGULATION.

BE IT ENACTED by the Assembly of the Denali Borough, Alaska that:

Section A. Classification. This ordinance is of a general and permanent nature.

Section 1. Article VII of the Charter of the Denali Borough is repealed and reenacted:

ARTICLE VII. PLANNING, PLATTING AND LAND USE REGULATION

Section 7.01 PLANNING COMMISSION. There shall be a Planning Commission to provide for planning, platting and land use regulation, consisting of persons elected from each voting district in the Borough. Each district shall elect two members to the Commission. The powers and duties of the Planning Commission and the terms and compensation of its members shall be as further provided by ordinance not consistent with the provisions of this Charter.

Section 7.02 PLANNING, PLATTING AND LAND USE REGULATION. No action restraining or limiting the use, conveyance or partition of any real property located in the Borough shall be permitted except upon the written consent of all the persons owning all interests in real property in the area that is to be subject to the pertinent action. Consent once given may be withdrawn until the Assembly takes final action on the pertinent measure.

Section 7.03 ZONING AND DISTRICTING. Any attempt to zone any portion of the Borough or to create any service area or local improvement district shall be subject to this Article to the degree, if any, that such action limits the use of real property.

Section 2. Effective Date. This ordinance becomes effective upon adoption by the Denali Borough Assembly, signature of the Mayor and approval of majority of the voters at the next regular election of the Denali Borough.
