DENALI BOROUGH, ALASKA

RESOLUTION NO. 94-06

A RESOLUTION RECOMMENDING CHANGES TO HOUSE BILL 305.

WHEREAS, the Denali Borough was incorporated on December 7, 1990; and

WHEREAS, the Denali Borough is working on its land selection under the Municipal Entitlement Act;

AND WHEREAS, the Denali Borough supports the intent of House Bill 305 for getting public land into private use, but has not yet received its' Land Entitlement Certification.

THEREFORE BE IT RESOLVED: the Denali Borough recommends adding a new Section to House Bill 305 to read as follows:

1.) The Commissioner of Natural Resources may not include lands for which at the time of its selection, under this section:

A.) A Municipality has made a selection under AS 29.65, unless the land selection is, at a later date, rejected by the Commissioner of Natural Resources or relinquished by the Municipality; or

B.) The Commissioner reasonably believes may be selected by a Municipality under AS 29.65.030, but the Commissioner may not withhold under this subparagraph the conveyance of title to land selected by the Municipality for more than three years after the date of the Municipality's Land Entitlement Certification.
