DENALI BOROUGH,
RESOLUTION NO. 94-05
A RESOLUTION RECOMMENDING
CHANGES TO HOUSE BILL 305.
WHEREAS, the Denali Borough was incorporated on
December 7, 1990, but has not yet received its Land Entitlement Certification;
and
WHEREAS, the Denali Borough is working on its land
selection under the Municipal Entitlement Act; and
WHEREAS, the Denali Borough supports the intent of
House Bill 305 for getting public land into private use, it is concerned about
the short time
frame for disposal of Borough lands;
AND WHEREAS, House Bill 305, Section 2 recommends
amending AS 29.65 to add a new section to read:
A.S. 29.65.075. Disposal of Land
Conveyed; Reversion to State of Undisposed Land. A municipality that has received or receives
land from the State under this title shall, within five years of the effective
date of this Act, sell 50 percent of the land received to private parties, and
within 10 years of the effective date of this Act shall sell 66 percent of the
land received to private parties. If a
municipality fails to sell as required by this section, all of the land the
municipality has received from the State that has not been sold reverts to
State ownership and is available for sale or lease as provided in AS 38.14.
THEREFORE BE IT RESOLVED, the Denali Borough
recommends deleting Section 2 amending AS 29.65 from House Bill 305.
